Order Acceptance
We reserve the right to decline service to any customer at our sole discretion.
Pricing and Payment
- The service location and monthly rate are set out in your invoice.
- Payment for monthly cleaning and chemical service is due on the 1st of each month and is a pre-paid service — for example, January’s service is due January 1st.Monthly service will be suspended until payment is current. No refund is given for a missed visit due to late payment.
- You authorize us to charge your monthly service fee plus any approved repairs or parts each month. Some repairs are approved by the Terms, larger repairs require additional approval. Details in ‘Customer’s Responsibility” section. You represent that any payment information you provide is accurate and that you’re authorized to use it.
- Routine maintenance chemicals are included in your monthly service fee. Specialty chemicals are not included (see Section “What’s Not Included”). We deliver and store pool chemicals near your pool equipment; we are not liable for damage they may cause to persons, animals, or property. If you apply chemicals to your own pool yourself, you’re responsible for reading and following the product’s warning labels — we are not liable for damages that result.
- We may change our fees or the services we provide with 30 days’ notice. Because you may cancel at any time, you will never be locked into a rate increase without a choice.
- We do our best to keep pricing accurate but may occasionally make typographical errors. We reserve the right to correct pricing errors and to cancel any order arising from one.
What’s Included — Company’s Responsibilities
Water Chemistry
- Test for pH, Alkalinity, Free Chlorine, Combined Chlorine, Stabilizer, Calcium Hardness, Saturation Index, Salt, and Phosphates (not every test is performed on every visit)
- Maintain salt, phosphate, chlorine, pH, and alkalinity levels; add algae-preventative treatments
- Salt is included at maintenance-dose levels only — start-up amounts incur an additional fee
System Check
- Check timers for accuracy
- Check equipment for proper operation and leaks
Cleaning
- Brush walls and steps each visit (full pool floor as needed)
- Empty debris from skimmers, pump baskets, and vacuum bags; net debris from top and bottom of pool
- Backwash as needed; replace DE (DE filters only)
- 2 filter cleans per 12 months (weekly customers only)
Service Standards
- We generally perform your pool visit on the same day of the week, each week, under normal circumstances
- We email a detailed report after each visit, including chemical readings, adjustments, and anything else important about your pool
- Technician(s) spend a maximum of 40 minutes per visit (20 minutes if two technicians are present)
Holidays and Weather
- If your service day falls on a holiday, no visit occurs and no refund is given for the missed visit. This is already calculated into our flat rate monthly price. Memorial Day, Independence Day & Labor Day. As well as week of Thanksgiving and Christmas.
- If weather or similar factors prevent service, we perform it within 1–3 days of your normal visit.
- In rare cases, we may only complete part of the normal weekly service — for example, no pole work in freezing temperatures, or light cleaning only, when we’re catching the full route back up after several bad-weather days.
Customer Responsibilities
- Access – You grant us permission to enter your pool/hot tub area and provide any gate codes, keys, or remotes needed for access.
Pets - You’re responsible for arranging for your pets during our visits. You accept responsibility for any injury to our technicians or damage to Company or contractor property caused by your animals. We are not responsible if a pet gets out during our visit.
- Water Flow – You’re responsible for maintaining proper water flow so cleaning equipment functions normally — low water or excess debris can stop flow. You may need to empty skimmers and filters between scheduled visits. The pool system should run its normal cycle, typically 6–12 hours per day, for chemicals to circulate properly; we will not add chemicals when water isn’t flowing. Failure to maintain proper water flow may cause serious equipment damage.
- Repairs & Parts – You authorize us to replace pool system parts up to $100 without prior notice; charges appear on your next bill. Anything over $100 requires your prior authorization, and payment is due immediately. Pool service depends on a working pool system — if repairs beyond $100 are needed, we’ll notify you. Repairs should be completed within 2 weeks or service may be suspended; no refund is given for a missed visit caused by an unresolved repair.
- Renters – If you’re renting the property, you must have the homeowner’s permission before hiring us — we are not liable for disputes between you and the homeowner.
What’s Not Included
- Acid wash, leak repair, stain removal, pool equipment repair or replacement, specialty chemicals, and other work outside routine maintenance
- Additional cleaning for excessive debris caused by factors outside our control — for example, roofing material from a roof install, lawn care waste, storm debris, or trash
Family Time
- We take 4 weeks off each year: Thanksgiving week, Christmas week, Spring Break, and Fall Break. No discounts or refunds are given for these weeks — your regular monthly rate still applies. This is already calculated into our flat rate monthly price.
Manufacturer’s Warranty and Disclaimers
- We don’t manufacture the equipment used in your pool system, and we don’t provide warranties on products beyond what the manufacturer provides.
Liability
- Parsons Pool Service, its employees, and/or independent contractors agree to provide swimming pool maintenance in a responsible manner.
To the fullest extent permitted by law, the Customer shall indemnify and hold harmless Parsons Pool Service, its Owner, employees and/or independent contractors, and their agents from claims, damages, losses, and expenses (including attorney’s fees) arising from performance of work under these Terms, to the extent such claim is attributable to bodily injury, sickness, disease, or death, or to injury or destruction of tangible property (other than the work itself), but only to the extent caused by the negligent acts or omissions of the Company, its subcontractors, or anyone directly or indirectly employed by them.
Parsons Pool Service is not responsible for any staining of plaster.
Our total liability for any claim is limited to the amount you’ve paid us for the services in question, except where liability results from our gross negligence, willful misconduct, or where death or bodily injury results from our acts or omissions.
Force Majeure
- We are not liable for delay or failure to perform caused by circumstances beyond our reasonable control, including acts of God, extreme weather, government action, labor disputes, or supply and equipment disruptions.
Governing Law
- These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. This governing law applies to the interpretation and enforcement of these Terms, including any arbitration conducted under “Dispute Resolution” Section.
Dispute Resolution
- Any dispute arising from these Terms will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You may instead pursue a claim in small-claims court if you notify us in writing within 60 days of your purchase. Each party is responsible for its own arbitration costs unless the arbitrator rules otherwise.
